The Effectiveness of custody hearing: an analysis of the Brazilian case

In Brazilian law, the hearing can be an instrument of protection and promotion of human rights, makes it possible to eliminate the idea of impunity, with which it is seen mainly by lay people, and demonstrating that this institute is not synonymous with freedom or injustice, but a way of ensuring the fundamental laws guaranteed in the Federal Constitution of Brazil of 1988. It seeks to establish here a relationship between the researched theme and Human Rights, seeking to promote analyses on facts that occurred before the legalization of the Custody Hearing in Brazil and the changes that came with the establishment of this institute. It is a study based on forensic literature, international norms and treaties such as the American   Convention on Human Rights and Specific Laws dealing with the theme. In this sense, the research also develops by analyzing the different positions and identifies which are the constitutional principles that were commonly violated in view of the non-existence of the Custody Hearing. This research also develops the possibility of the Applicability of Article 37 §6 of the Federal Constitution of Brazil of 1988, as well as developed an investigation of the concept of general repercussion and its consequences, in view of the Supreme Court having presented such an understanding for the question. Muros altos e rios de sangue : o Sistema Penitenciário Federal e a expansão das facções criminosas

Neste estudo, pretende-se verificar a inter-relação existente entre o sistema penitenciário estadual, tomando como base o Estado de Rondônia, parte da Amazônia Ocidental, e o chamado Sistema Penitenciário Federal, avaliando se a movimentação de presos entre esses dois modelos prisionais, de alguma forma, contribui para a expansão de gangues prisionais ou, ainda, se estimula ou favorece a emergência de novos coletivos de presos pelos estados e de que forma isso impacta sobre o monopólio da violência e do controle estatal das prisões. De fato, com as gangues prisionais, surge, aos poucos, um novo modelo de comportamento para os presos, com códigos próprios, rígidos e que conduzem à dominação de grande parte da população carcerária e do espaço prisional. Com isso, a prisão, que deveria ser uma instituição voltada para o controle da violência e da criminalidade, para a ressocialização do preso, transforma-se em ambiente de fomento de mais violência e mais crimes, sendo essa, enfim, a razão da criação do Sistema Penitenciária Federal como mecanismo de controle dessa violência e também como forma de combater as gangues de presos. Contudo, como consequência de sua criação, deu-se o encontro de lideranças criminosas de todo o país, formando-se o que se chamou de “Comitê Central do Crime”.This study, we intend to verify the existing relationship between the state penitentiary system, based on the State of Rondônia, part of the Western Amazon, and the so-called Federal Penitentiary System, to evaluating whether the movement of prisoners between these two models in some way, contributes to the expansion of prison gangs, or, still, stimulates or favors the emergence of new prisoners' groups by states, and how this impacts on the monopoly of violence and estatal control of prisons. In fact, with the prison gangs, gradually, comes up a new model of behavior for prisoners, with rigid codes that led to domination of a large part of the prison population and the prison space. With this, the prison, which should be an institution focused on the control of violence and crime, for the resocialization of the prisoner, becomes an environment for the promotion of more violence and more crimes,which was, in fact, the reason for the creation of the Federal Penitentiary System as a mechanism to control this violence and also as a way to combat the gangs of prisoners. However, as a consequence of its creation, occurred it meeting of criminal leaders from all over the country, forming what was called "Central Crime Committee"

Rio 2016: The preparations and challenges of the olympic city

Esse trabalho tem por objetivo discutir e analisar o processo de preparação da cidade do Rio de Janeiro para a realização dos megaeventos esportivos que nela ocorrerão durante essa década. Leva-se em conta que tal discussão se torna plenamente justificável devido à complexidade desse processo e aos consideráveis recursos públicos e privados direcionados à execução desses megaeventos. A metodologia utilizada para a elaboração deste texto foi apoiada em revisão bibliográfica tendo sido consultados documentos oficiais, trabalhos acadêmicos, reportagens de jornais, dentre outros. Os resultados encontrados sugerem que os desafios a serem enfrentados pela sociedade brasileira durante a preparação para os megaeventos esportivos são bastante expressivos. No entanto, acredita-se que se for efetivada uma visão de longo prazo projetada mais particularmente no Dossiê de Candidatura dos Jogos Olímpicos e Paraolímpicos de 2016, acredita-se que o Brasil e a cidade do Rio de Janeiro poderão colher benefícios duradouros e com isso alcançar destaque no competitivo mercado internacional de eventos.The aim of this paper is to discuss and analyze the preparation process of Rio de Janeiro as the host-city of mega sporting events during this decade. The process complexity and the amount of public and private money that will be invested in these mega events justify this discussion.  A literature review was made by searching in official documents, scholarly articles, journals etc. The results suggest that the challenges which Brazil society will face during the preparation for the mega sporting events are very significant. However, if the long term strategy were accomplished for the 2016 Olympic and Paralympic games the city of Rio de Janeiro as the Projects showed, Brazil and Rio de Janeiro can have positives and durable benefits and then achieve prominence in the competitive international events market

A EPISTEMIOLOGIA DO GARANTISMO PENAL E SUA VALIDADE TEÓRICA: Uma discussão sobre a crise da violência

A ausência de políticas públicas sociais que para atender as relações mínima de convivência em que problemas como a fome, a falta de acesso a educação, carência de programas que importem em emprego e renda, infraestrutura sanitária deficiente ou inexistente, entre outras, são elementos que potencializam a violência. A utilização massiva do Direito Penal como política pública para solucionar esses problemas, tem se mostrado ineficaz, por seu aspecto punitivo encarcerador. Assim, o Direito Penal de Garantia vem em busca da estrita legalidade e proteção do cidadão contra a ânsia desmedida do Estado em punir para resolver problemas sociais. Este trabalho discutirá as correntes de pensamento criminológica, com vistas a entender a importância da proteção desses institutos no sistema penal brasileiro

Iniciação à docência em Física inspirada no ensino por investigação

Os limitados resultados da educação científica e, em especial, do ensino de Física, explicam-se, em parte, pelas carências na formação específica de professores na área. Os processos de iniciação à docência sofrem para conectar as teorias pedagógicas a uma realidade escolar depauperada, e isso desafia ainda mais a transposição dos conteúdos de referência em vivências cativantes para os alunos. Este artigo narra uma experiência de iniciação docente de um licenciando em Física, por ocasião de sua participação em um projeto de extensão universitária, e as reflexões decorrentes. Relata-se sua inspiração por um referencial pedagógico e se apresenta o planejamento didático e a descrição de seis aulas sobre “Trabalho e Energia” para uma turma de primeiro ano do ensino médio, na perspectiva do “ensino por investigação”

FisioLung: A System for Training and Monitoring of Respiratory Physiotherapy Sessions

The chest vibration technique is considered a good alternative for bronchial hygiene. However, this technique is difficult to perform because it needs a chest on exact range frequency. We built a tool to analyze its execution that helped professionals to learn him. It is possible to monitor the evolution of the patient with a monitoring system based on the record of sessions and observe the application of the vibration techniques as well. This work proposed the developed system integrating hardware and software named Fisiolung. The architecture has a glove with an accelerometer to capture the vibration data and a NodeMCU ESP32 board used to process them. The Flutter mobile application receives the collected data and manages the session. The system can record physiotherapy sessions by registering the patient’s and the professional’s data, anamnesis information, techniques used, and analysis of the manual chest vibration technique stored. On the analysis screen, it is possible to note the graphs of peak frequency versus time and the average of peak frequency versus time, as well as session information such as analysis time, anamnesis data, and applicable techniques. The researchers conducted some experiments using the system, and the initial feedback indicated that physiotherapists could adopt the system and benefit from utilizing the Vibrocompression technique
